My boyfriend has had weekend visits with his son for 9 years and is now in the position to be able to have his son on a full time basis. Is $$$ always the deciding factor in who gets the child? It also depends on where he would have the best home as far as who will take care of the child better emotionally and physically. At the age of 12, the court won't switch custody unless there is abuse, or it's what the child really wants to do. You can file a petition for custody, but unless circumstances have changed drastically for the worst in his mothers home, or he wants to live with you (the judge will interview him alone to find out his wishes), I doubt the court will grant custody to his father now.
