Can I sue my ex husband for my attorney's fees?

I am a stay at home mother of 2, remarried. My ex filed for full custody, in trial his allegations were never proven, however mine were. The judge changed custody from every weekend with father to every other but in turn gave him some extra days that he didn't have before. Bottom line he got a decrease overall in visitation. My ex filed an appeal and lost that too. Now if your ex husband brought forth an outrageous suit that had no merit as defined by the law then you may have a case.



Just because his allegations were never proven does not mean his allegations are false. All courts have a burden of proof the plaintiff has to meet. Just because the burden of proof is not met does not mean what is alleged is untrue.



I am not accusing you of anything untoward regarding this matter between your ex and you. Rather, your ex alleged issues and failed to meet the burden of proof. If his allegations were false, then they can't meet the burden of proof.
