In my custody agreement,it states this:
Mutual Agreement or Specified Terms for Possession: It is ordered that the conservators shall have possession of the child at times mutual agreed to in advance by the parties and in the absence of mutual agreement it is ordered that the conservators shall have possession of the child under the specified terms set out in this possession order.
Then it states:
Parents who reside 100 miles or less apart:
Except as otherwise explicitly provided in this possession order,when Michael E. G. resides 100 miles or less from the primary residence of the child M.E.D., shall have the right to possession of the child as follows.
1. on his days off but must be submitted in writing one month in advance.
Now can someone explain this to mean before I go back to court. I just want to equal time with my daughter. But I don't understand what I am reading..I guess emotions are in the way.How do I change he custody agreement? I live in texas.?Does X live near by? Both parties are in agreement to work visitation out. If not agreeable, michael must let you know in a months notice (written %26amp; delivered to you) when he wants visitation this is only if he lives under 100 miles. If you do not agree more than likely the court will set the times, which i really don't know why they didn't in the first place unless he works most of the time, Call the attorney that filed this to the courts and ask what they mean. Sounds like yall are suppose to share custody on days he is off work. Doesn't sound equal unless he has half of the time.
