How can you change a custody agreement in Florida w/o spending a fortune?

My sister and her ex have the MOST RIDICULOUS arrangement ever....it's a 50/50 split and basically it's not written in stone....so whenever he changes his availiability/job/mood he changes when he had her etc. My sister has worked the same M-F 8-5 job since being pregnant....and he's had like 5-6 jobs, my neice is almost 2. Oh he also has his liscense suspended and no car.....so my sister has to cart her daughter back and forth to him EVERY day...b/c that's when he's availiable....and their agreement basically says if he's not at work he gets her. My sister cannot afford to go back to court and undo any of this, what resources are there to help her?

She just has to have the daughter available, nothing more. He needs to move closer so he can ride a bike or walk to get her if he wants her daily.



The agreement says he gets her if he's not at work, but does not say she has to bring him the child. If he cannot get her, that's his own problem and needs to understand that from here on out.



Once she stops pandering to him, he'll get mad. He may even take it back to court, if he does.. your sister will win hands down. A judge won't like it if a father is that irresponsible and expects the mother to cater to him!



Your sister can call around to attorneys and see who will give her a free consult... most list in the yellow pages they give one free consult. They'll tell her the same thing i just said, but she'll feel better about it coming from an attorney.



Now, there is legal aid that might help her get the agreement changed around if she'd like.. or see if someone will work pro bono (which means for charity).

Honestly, with shared custody, a parent who's not working should always have the kid, look at it this way, she's saving on child care.
