What happens in family court when one parent owes arrears and now w/ custody changed filed for support?

one parent, now a custodial parent, also paying support, has arrears judgement, asks for support from the other parent? each has custody of a child, one has already placed order for support w/ arrears, and has asked for other parent to pay to this parent...how would that work in New York state?

both will have to pay the other, or present order simply be adjusted considering the new custodial arrangement. each parent, now divorced has one child

help...need to know what to expect...What happens in family court when one parent owes arrears and now w/ custody changed filed for support?You would still have to pay what is owed, and from the date your child support starts you should be getting a check in the mail from your other.

no matter if your in the arrears, you still have to pay what is owed, even if you switched custody.your payments should stop right after your last payment. So you should pay your arrears with the checks that get sent to you. it may be a pain in the beginning, but its better to do that than paying late fees, and letting your arrears build up. Pay what you owe.

If you have more questions call the social services dept. to the one thats enforcing the child support.they should help you out.
