1) The custodial parent can voluntarily relinquish custody. (Ask the parent to give custody to the other one)



2) The non-custodial parent can petition the court for custody and a judge can award it. With a 13 year old child, the judge will take the child's opinion into consideration as well.



Note: The other parent doesn't have to have custody for you to live with him/her. It's not at all unusual for a teen to live with a non-custodial parent. Custody is just a legal status used to mediate disputes.
